TERMS OF SERVICE
Article 1 Purpose
1. imgnom Terms of Service (hereinafter referred to as “These Terms and Conditions”) are the rights, obligations and responsibilities of members and “imgnom” when members use image file upload-related services (hereinafter referred to as “Services”) provided by imgnom. The purpose is to regulate.
2. If a person who wishes to become a member clicks the “Agree to Terms and Conditions” button after going through the prescribed procedures set by “imgnom,” he or she is deemed to have agreed to these Terms and Conditions. The rights, obligations and responsibilities of members and “imgnom” other than those specified in these Terms and Conditions are governed by the Telecommunications Business Act and other relevant laws and regulations of the Republic of Korea and commercial practices.
Article 2 Definition of Terms
1. Member: refers to a person who accesses “imgnom”, registers as an “imgnom” member in accordance with these Terms and Conditions, and receives services provided by “imgnom”.
2. Terms not specified in other terms and conditions shall be subject to relevant laws and general practices.
Article 3 Effect and change of Terms of Use
1. These terms and conditions are effective for all anonymous users and all members who wish to use the service.
2. The contents of these terms and conditions become effective when an anonymous user or member agrees to them and uses or signs up for the service.
3. Agree to the terms and conditions by clicking on the 'Membership Terms and Conditions' on the screen when applying for use - 'I have read and agree to all of the above.' This is considered to be done by checking the items. The consent of existing registered members is subject to paragraph 4.
4. If a member does not agree to the changed terms and conditions, he or she may stop using the service and terminate the service agreement (withdrawal of membership). If he or she continues to use the service after the application of the changed terms and conditions, he or she will be deemed to have agreed to the changes in the terms and conditions. do.
5. If a necessary reason arises, “imgnom” may revise the Terms and Conditions to the extent that it does not violate relevant laws and regulations. Amendments will be notified through a notice, and the revised terms and conditions will take effect 7 days after they are posted.
Article 4 Membership registration
1. Those who wish to become members apply for membership by filling out the membership information according to the registration form set by “imgnom” and clicking the “Register” button.
2. “imgnom” recognizes as a member the person who applied for membership as specified in Paragraph 1, unless the applicant falls under any of the following.
① If there are false information, omissions, or typos in the registration information.
② When using multiple accounts
③ When a member who has experienced suspension or loss of membership due to violation of laws or terms and conditions, other reasons attributable to the member, or Article 7 Paragraph 2 applies again.
④ If it is judged that registering as another member will significantly impede the service operation of “imgnom”
3. The membership contract is established when “imgnom” member registration is completed.
4. Even after the membership contract is established, consent for use may be withdrawn if a reason is discovered under each item of Paragraph 2, and the member may not claim any rights in relation to the use of the service.
Article 5 Provision and change of services
1. “imgnom” provides the following services to members.
① Upload and share images
② All other services to be provided to members by “imgnom” itself or through cooperation agreements with other companies.
2. “imgnom” may notify members of the changed service contents and provision date in the manner set forth in Article 8.
Article 6 Service suspension
1. "imgnom" may temporarily suspend the provision of services in the event of maintenance, inspection, replacement, breakdown of information and communication equipment such as computers, or interruption of communication, replacement with a new service, or other "imgnom" The currently provided service may be completely discontinued for reasons deemed appropriate.
2. In the case of service interruption pursuant to Paragraph 1, “imgnom” will notify members in the manner prescribed in Article 8, Paragraph 2. However, this does not apply if prior notice is not possible due to service interruption due to reasons beyond the control of "imgnom" (disk failure without intention or negligence of the system administrator, system crash, etc.).
Article 7 Withdrawal of membership, loss of qualification, etc.
1. A member may request “imgnom” to cancel his/her membership registration (withdrawal of membership) at any time, and “imgnom” will take steps to cancel the member’s membership registration in accordance with the personal information handling policy.
2. If a member falls under any of the following reasons, “imgnom” may restrict, suspend or lose the member’s membership in an appropriate manner.
① When engaging in activities that violate notices or notices on each bulletin board
② If false information is registered when applying for membership
③ In the case of actions that constitute a threat to the “Service”, such as interfering with another person’s use of the “Service” or stealing that information.
④ If an act is prohibited by the law or these Terms and Conditions or is against public order and morals.
3. If “imgnom” decides to revoke a member’s membership, the member’s registration will be cancelled.
4. If you cancel your membership, the uploaded images will not be deleted. If you wish to delete the uploaded images, you must delete them yourself and then withdraw your membership.
5. Regarding the reasons for personal information infringement remaining in posts and comments, even after withdrawal, if you request the Personal Information Protection Responsibility Team according to the Personal Information Handling Policy to provide proof of identity, related reasons, and attached materials to confirm the author's identity, they will be individually reviewed after deliberation. It may be deleted.
6. If a member has no log-in record to use the service for one consecutive year while using the service after registering as a member in accordance with these Terms and Conditions, the account may be treated as dormant, and "imgnom" will lose the member's membership. You can do it.
Article 8 Notification to members
1. When notifying a specific member, “imgnom” may notify the member via e-mail and notices listed in “imgnom’s” member information.
2. When “imgnom” notifies an unspecified number of members, individual notification may be replaced by posting on “imgnom’s” notices and related bulletin boards.
Article 9 Protection of personal information of members
1. "imgnom" strives to protect members' personal information, including member registration information, in accordance with relevant laws and regulations.
2. Protection of members’ personal information is governed by relevant laws and regulations and the “Personal Information Handling Policy” established by “imgnom.”
Article 10 Obligations of “imgnom”
1. “imgnom” does not engage in any acts prohibited by the law or these Terms and Conditions or against public order and morals, and strives to provide continuous and stable services in accordance with the provisions of these Terms and Conditions.
2. “imgnom” does not send commercial advertising emails that members do not want.
Article 11 Obligations regarding member ID and password
1. Except in cases where “imgnom” assumes responsibility in accordance with relevant laws and regulations or the “Personal Information Handling Policy,” each member is responsible for managing his or her own ID and password.
2. Members must not allow third parties to use their ID and password.
3. If members become aware that their ID and password have been stolen or are being used by a third party, they must immediately notify “imgnom” and follow any instructions provided by “imgnom.”
Article 12 Obligations of non-members and members
Members must not engage in any of the following acts.
1. Uploading and stealing copyrighted images from “imgnom”
2. Using “imgnom” to induce paid use
If a member commits an act falling under any of the above items, "imgnom" may restrict, suspend, or lose the member's membership in an appropriate manner.
Members are responsible for compensating for damages due to reasons attributable to them.
Article 13 Matters related to postings
1. In the following cases, “imgnom” may block, delete or move the image without prior notice to the member, and may restrict, suspend or lose the member’s membership.
① Violating the terms and conditions set forth in the service provided by “imgnom” and other regulations regarding service use.
② Content that violates “imgnom” notices or notices on each bulletin board
③ Content that infringes on the rights, such as copyright, of a third party
④ Content that is judged to be in violation of other relevant laws and regulations
3. If “imgnom” receives a request to suspend posting of an image uploaded by a member on the basis of infringement of the legal rights of another member or a third party, “imgnom” may delete the image, and may delete the image if there is an agreement between the requester and the member or the result of legal action, etc. Once received in "imgnom", it will be followed accordingly.
Article 14 Attribution of copyright and restrictions on use
1. Copyright and other intellectual property rights for works created by “imgnom” belong to “imgnom”.
2. Non-members or members must not use the information obtained by using “imgnom” for commercial purposes or allow a third party to use the information obtained by using “imgnom” by copying, transmitting, publishing, distributing, broadcasting or other methods without the prior consent of “imgnom.”
3. The copyright of images posted within the service by non-members or members belongs to the member. However, for the purpose of operating, displaying, transmitting, distributing, and promoting the imgnom service, posts registered by members may be used as follows, free of charge, without separate permission from members, and within a reasonable range in accordance with fair practices stipulated in the Copyright Act.
① Copying, modifying, adapting, displaying, transmitting, distributing member posts within the service, and creating edited works within the scope of not damaging the copyright.
② Reproducing and transmitting necessary data (post title and content, posting date, number of views, etc.) to relevant affiliates in order to provide improved services such as post search services. However, in this case, "imgnom" will not provide member's personal information without separate consent.
③ Providing, displaying or promoting the contents of members’ posts to service affiliates such as media and telecommunication companies. However, in this case, "imgnom" will not provide member's personal information without separate consent.
4. The non-member or member who uploaded the image is responsible for any problems arising from images uploaded by non-members or members, and images that infringe the rights of others may be deleted at the request of the infringing party or authorized representative. .
6. If the uploaded image infringes the copyright of another person or work, the person who uploaded the image will be held civilly and criminally liable. If "imgnom" receives an objection, such as a claim for damages, from another person for this reason, it must bear all damages resulting from the image.
Article 15 Jurisdiction
The laws of the Republic of Korea apply to disputes regarding the use of services that arise between “imgnom” and members, and lawsuits arising from these disputes shall be filed in the courts of the Republic of Korea, which have jurisdiction under the Civil Procedure Act.
Supplementary provisions
These terms and conditions apply from March 4, 2024.
